PUBLIC OFFER
regarding the provision of a charitable donation
1.1. This public offer regarding the provision of a charitable donation (hereinafter referred to as the "Offer") is an offer of the Charitable Organization "The Charitable Fund "Restoration of Prosperity"": Irpin, st. Mineralna, building 7e, room 1057 (hereinafter referred to as the "Beneficiary") to an unspecified circle of able-bodied individuals and legal entities under private law who voluntarily carry out charitable activities (hereinafter referred to as the "Benefactor"), to enter into an agreement on the provision of a charitable donation (hereinafter referred to as the "Agreement ยป) on the terms described in this Offer, with each Benefactor who applies.
1.2. This Offer is an offer to conclude a contract in accordance with Art. 641 of the Civil Code of Ukraine.
1.3. This Offer comes into force from the moment it is posted on the website at the following link: https://vdua.org.ua (hereinafter referred to as the "Site"). This Offer is open-ended and may be changed or withdrawn by the Beneficiary at any time (prior to its acceptance by the Benefactor) by posting relevant information on the Site.
2. Subject of the Agreement
2.1. According to this Agreement, the Benefactor freely and irrevocably transfers money to the property of the Beneficiary as a voluntary charitable donation, and the Beneficiary accepts such a charitable donation and undertakes to transfer to the Benefactor the souvenir products posted on the Site. All funds received by the Beneficiary in connection with the activities of the Site, the latter undertakes to transfer to charity.
2.2. The Benefactor's transfer of funds under this Agreement is recognized as a charitable donation in accordance with Art. 6 of the Law of Ukraine "On Charitable Activities and Charitable Organizations".
2.3. The benefactor independently determines the amount of the charitable donation. The Benefactor has the right to ask the Beneficiary and obtain information about the nature and amount of the necessary charitable assistance for specific charitable organizations to which the assistance will be transferred.
2.4. The conclusion and performance of this Agreement is not intended and does not provide for the profit of any of the parties.
3. Making a donation and accepting the Offer
3.1. The benefactor independently determines the size of the charitable donation and makes it by (i) making a money transfer using the payment forms and means posted on the Site. Charitable donations are perpetual, and the term of their use by the Beneficiary is not limited.
3.2. When making a donation, for the correct identification of the payer, the Benefactor indicates his contact information: first and last name, name of the legal entity, e-mail address and/or phone number, other data that allow identification of the Benefactor, as well as other data.
3.3. Acceptance of the Offer is considered to be its complete and unconditional acceptance by the Benefactor taking actions to transfer the funds of the charitable donation to the Beneficiary in one of the ways specified in the Offer. The offer is considered accepted and the Agreement concluded from the date of crediting the funds to the Beneficiary's current account.
3.4. By accepting the Offer, the Benefactor confirms that he agrees with all the terms of the Offer, is fully aware of and agrees with the subject matter and terms of the Agreement.
3.5. The Beneficiary sends, or transfers to the Benefactor in any other available way, souvenir products as a thank you for the charitable assistance provided.
3.6. Expenses related to making charitable donations (transfer fees, taxes, fees, etc.) are borne by the Benefactor, if such expenses are charged to the Benefactor, and the Beneficiary, if such expenses are charged to the Beneficiary. The benefactor realizes and agrees that a part of him
of a charitable donation may be used by the Beneficiary to cover expenses related to making charitable donations, if such expenses are charged by third parties by default and cannot be avoided (for example, fees of acquiring payment systems, bank fees, etc.).
4. Rights and obligations of the parties
4.1. The Beneficiary undertakes to transfer all funds received by him in connection with the Site's activities to charity.
4.2. The beneficiary has the right to independently choose the charitable organizations to which he transfers the funds received in connection with the activities of the Site.
4.3. By making a charitable donation, the Benefactor unconditionally affirms his legal capacity, voluntariness of entering into the deed, that the subject of the charitable donation is not subject to prohibition, arrest, is not in lien, is not encumbered by any other rights of third parties and was not acquired in violation of the provisions of Law of Ukraine No. 361-IX "On preventing and combating the legalization (laundering) of proceeds obtained through crime, the financing of terrorism, and the financing of the proliferation of weapons of mass destruction."
5. Final provisions
5.1. By accepting the Offer, the Beneficiary gives the Beneficiary consent to the processing of his personal data, which are disclosed by the Benefactor when making a charitable donation, in order to fulfill the terms of the Agreement. Such personal data may include: name, surname and patronymic, address, place of residence, e-mail address, telephone number. Permitted types of personal data processing include their collection, registration, accumulation, storage, adaptation, change, renewal, use and dissemination (distribution, implementation, transfer), depersonalization and destruction. The Beneficiary undertakes not to disclose the Benefactor's personal data to third parties without the Benefactor's permission, except in cases where such disclosure is required by state authorities or is otherwise required in accordance with the legislation of Ukraine. The benefactor confirms that he has been notified of the rights established by the Law of Ukraine "On the Protection of Personal Data". The Benefactor's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" are known and understood by him.
5.2. The Benefactor gives his consent to the fact that his contact information can be used to the Beneficiary to send souvenir products, letters and messages, including electronic ones, to the Benefactor. At the same time, the Beneficiary undertakes not to provide information about the Benefactor's contact details to third parties, except in cases expressly provided for by the legislation of Ukraine.
5.3. In the event of disputes between the parties to this Agreement, they must be resolved through negotiations. If a negotiated solution is impossible, disputes are considered by courts in the manner established by law.
